This document sets out the terms and conditions that apply when you use the website of Niu Beach Hale Ohana LLC, make a booking, or stay at one of our beach houses. Please take the time to read these terms carefully before you book. When you make a booking or use our services, you agree to be bound by this agreement, which you may keep for your records.
1. Acceptance of This Agreement
By accessing our website, submitting an enquiry, making a booking, or staying at any of our properties, you accept these terms of service and agree to be bound by them. If you do not agree with any part of these terms, please do not use our website or our services.
These terms form the entire agreement between you and Niu Beach Hale Ohana LLC regarding the use of our services, and they replace any prior discussions, proposals, or agreements on the same subject. We may update these terms from time to time, and the version that applies to any particular booking is the version in effect at the time that booking is confirmed.
If a provision of these terms is found to be unenforceable, the remaining provisions will continue to apply in full force. Our failure to enforce any part of these terms does not mean that we give up our right to enforce that part later.
2. About Our Company
Niu Beach Hale Ohana LLC is a hospitality company that provides beach vacation rentals, ohana house stays, event hosting, and property care services. Our business is built around the idea that a beach house should feel like an extension of your family, and that ohana, meaning family in Hawaiian, should be at the heart of every stay.
Our registered address is 1422 Sycamore Dr, Santa Clara - 84765-1244, United States (US). You can reach us by email at query@niubeach.autos or by telephone at +17656948092. Our website and digital services are developed and operated by the developer Niubeach, who works on our behalf to keep our online experience secure and easy to use.
This company information is provided so that you always know who you are dealing with. When these terms refer to we, us, or our, they mean Niu Beach Hale Ohana LLC. When they refer to you or your, they mean the person making a booking or using our services.
3. Eligibility and Use of the Website
Our services are intended for use by guests who are at least eighteen years of age and who are able to form a legally binding agreement. By making a booking, you confirm that you are of sufficient age and that all information you provide to us is true and accurate.
You agree to use our website only for lawful purposes and in a way that does not interfere with its normal operation. You must not attempt to gain unauthorized access to our systems, introduce harmful software, or collect information about other visitors without their consent.
You are responsible for keeping any account details you use with our website confidential. Where we provide a guest account, you agree to notify us promptly if you become aware of any unauthorized use of that account.
4. Bookings and Reservations
You may enquire about availability through our website, by email, or by telephone. A booking is confirmed only when we have accepted your reservation and you have received written confirmation from us, together with details of any deposit or payment due. Until that written confirmation is received, any enquiry or provisional hold does not guarantee a property, a price, or a set of dates, and we encourage you to complete your booking in good time for the season you want.
When we confirm a booking we will share with you the essential details of your stay: the name and address of the property, your arrival and departure dates, the number of guests agreed, the total price including any fees and taxes, and the reference number for your reservation. Please keep this confirmation in a safe place and check that all the details are correct when you receive it. If anything looks wrong, let us know immediately so we can correct the record before the details become final.
A reservation may be held by a single responsible adult who is at least eighteen years old and who acts as the primary point of contact for the whole group. That person is responsible for communicating with us on behalf of the group and for making sure the other members of the party understand and follow these terms and the relevant house rules. We may contact the primary guest about updates to the booking, changes to check-in arrangements, or any matters that arise during the stay.
When you make a booking, you agree to provide us with accurate information about the number of guests, the dates of your stay, and any special requirements. If the information you provide differs from the actual use of the property, we may need to adjust the booking or apply additional charges.
We reserve the right to decline any booking at our discretion, including where availability has changed, where there are concerns about the property fit, or where a previous stay did not follow our house rules. We will always aim to explain our decision politely and to help you find an alternative if possible.
5. Pricing and Payment
Prices for each property are shown for the relevant dates and are subject to change until a booking is confirmed. Confirmed prices are honoured, and we will not increase the price of your stay after you have received written confirmation.
Prices may include cleaning fees, local taxes, and certain amenities, and these will be shown clearly before you confirm. Any additional services, such as caterers, equipment hire, or concierge bookings, are charged separately and will be agreed with you in advance.
Payment is due according to the schedule set out in your confirmation. We may ask for a deposit at booking and the balance before arrival. Where payment providers are used, their own terms and security practices apply. Late payment may result in the cancellation of a reservation or the withholding of services.
All prices are quoted and payable in US dollars unless we agree otherwise in writing. Should you pay using a card or account held in another currency, your bank or payment provider will apply its own conversion rate and may charge a small foreign transaction fee, which is your responsibility. We will always show you the total in US dollars before you confirm, so you know exactly what you are being asked to pay.
In some cases we offer a damage deposit or security deposit that is held against the cost of breakages or excessive cleaning and then released after your stay. Where a security deposit applies, we will explain the amount and the process for its release at the time of booking. Refunds of security deposits are normally issued within a short number of business days after your departure, provided you return the property in good condition and we receive no claims against the deposit.
If you would like a written receipt for any payment, including a breakdown of the nightly rate, cleaning fee, and taxes, we will be glad to provide one. Clear records help both of us, so please keep your confirmation and receipts alongside any correspondence about your stay.
6. Cancellations and Changes
If you need to cancel a booking, please tell us as soon as possible. Cancellation terms may vary depending on the property and the season, and they will be summarised in your confirmation. In general, a full or partial refund may be available if you cancel by the stated deadline.
Changes to your dates, group size, or property may be possible subject to availability. We will do our best to accommodate reasonable requests, but we cannot guarantee that changes will be accepted, and any price difference will be calculated fairly.
In the unlikely event that we must cancel your booking due to circumstances beyond our control, such as a severe storm or essential maintenance, we will offer you a full refund of any amounts paid or an alternative date and property of equal standing. We are not responsible for any third-party costs you incur because of such a cancellation.
7. Guest Conduct and House Rules
Every property has a set of house rules that are provided to you before or at check-in. These rules cover matters such as quiet hours, smoking, pets, and the care of furnishings. By staying with us you agree to follow these rules for the comfort and safety of everyone.
You are responsible for the conduct of every person in your group, including children and any visitors you invite. Please keep noise to a reasonable level, respect the neighbours and the surrounding community, and treat the property as you would your own home.
If the house rules are not followed, we reserve the right to end the stay early without a refund, to charge for any damage or extra cleaning required, and to decline future bookings. We will always raise concerns in a respectful and fair manner before taking such steps.
8. Property Safety and Damage
The sea and the shoreline are wonderful but can be unpredictable. We provide guidance on tides, currents, and local safety, and you are responsible for exercising reasonable care and for supervising children near the water at all times.
Please report any damage or breakage to us promptly so that we can repair or replace the item quickly for the next guests. Minor breakages that you tell us about are usually covered without dispute. A security deposit may be held and used to cover damage beyond normal wear, excessive cleaning, or items that are missing.
We ask that you do not move heavy furniture, redecorate, or make any alterations to the property. If you notice a maintenance issue, please let our care team know and we will address it as swiftly as we can, ideally during your stay.
9. Persons Using the Property
Each property is described with a maximum occupancy, which reflects the number of beds and the size of the home. Please do not exceed the maximum number of overnight guests without our prior written agreement, as this affects safety and the comfort of the stay.
If you wish to have non-resident visitors during the day, please tell us in advance so we can confirm that this fits with the property and its surroundings. We may ask that daytime visitors are limited in number and that they leave the property at a reasonable hour.
Only registered guests may stay overnight. Where we suspect an unauthorized number of guests, we may carry out a check and, if necessary, charge a fair additional amount or apply the terms set out in the house rules.
10. Events and Gatherings
We are glad to host birthdays, reunions, and other gatherings at select properties. Any event must be discussed with us and agreed in writing before the date, because events have different space, noise, and safety needs than a standard stay.
For events we may agree on a guest count, a start and end time, and arrangements for catering, seating, and cleaning. There may be additional fees to cover the extra effort and any added wear. We will provide a clear written summary so there are no surprises.
We reserve the right to decline events that may disturb neighbours or that exceed the capacity of the property or our insurance. By confirming an event, you agree to manage your attendees responsibly and to leave the property as it was found, subject to the arrangements we agree.
11. Property Care for Owners
Owners who entrust us with their beach house agree to a separate care agreement that outlines the services we provide, the schedule of visits, and the way we communicate. These owner terms sit alongside, and by agreement override, the general guest terms where there is any difference.
Our property care service includes cleaning, maintenance checks, key management, and reporting on the condition of the home. Owners grant us access to the property to carry out these services and agree that we may use reasonable contractors to complete specialised work.
We take reasonable care to protect the property and its contents, but owners are responsible for maintaining appropriate insurance cover. We will report any damage or incident to owners promptly and assist them with the claims process where we can.
12. Limitation of Liability
To the maximum extent permitted by law, Niu Beach Hale Ohana LLC, its partners, and its staff are not liable for any indirect, incidental, or consequential damages arising from the use of our website or services, or from any stay at our properties.
We take reasonable care to keep our website secure and our properties safe, but we cannot be responsible for events beyond our control, including but not limited to storms, power failures, service interruptions by third parties, or the actions of other guests and visitors.
Guests stay at their own risk in beach and water environments and are responsible for their own safety, equipment, and the supervision of their companions. Where liability is not excluded by law, our total liability to you in connection with any stay or service will not exceed the total amount you paid for that stay.
13. Intellectual Property
The content of our website, including text, images, logos, and the overall design, is the property of Niu Beach Hale Ohana LLC or our licensors and is protected by copyright and trademark law. You may view and print content for your own personal, non-commercial use.
You must not reproduce, distribute, modify, or create derivative works from our website content without our prior written permission. The name Niu Beach Hale Ohana and related marks may not be used in ways that could confuse or mislead as to the source of goods or services.
Anything you send us in connection with a booking or an enquiry, such as a message or photo, is used only to help you. We do not claim ownership of your content, and we will not use it in our marketing without asking you first.
14. Dispute Resolution and Governing Law
These terms are governed by the laws of the United States and the state of California, without regard to conflict of law principles. Any dispute arising out of or relating to these terms or our services will, where agreement cannot be reached by friendly discussion, be resolved through the courts of our registered location in California.
We always prefer to resolve a concern in a warm and fair manner, and we ask that you give us the opportunity to address any issue before resorting to formal proceedings. Please contact us first so we can listen and put things right if possible.
Nothing in these terms limits your rights under consumer protection laws where those rights cannot be excluded by agreement. If any part of this dispute section is found to be unenforceable, the rest of the document will continue to apply.
15. Contact and Questions
If you have any questions about these terms, about a booking, or about our services, we would be glad to help. Please reach out to us using the details below and we will respond as soon as we can.
